Pet Trusts - Do You Have One For Your Pets?

By Michael Pancheri It is no secret that people get excited about their pets. And, that feeling does not go away when it comes time to doing some estate planning for the family - because pets are part of the family too! Unfortunately, until recently, there just wasnt a whole lot that could be done for pets. In most cases, a loving family member would just take over after the owners death. That worked in many cases, but not always. In fact, in far too many cases there were no loving family members willing or able to step up to the plate and take on that responsibility. The end result - the pets ended up on the street or in local animal shelters. Many times, an owner would sweeten the offer by leaving some money for the pet’s care under his or her will. However, since there was no legal obligation to use the money for the pets, you can guess what happened. In many cases, the family member or friend took the money and put the pet in the shelter. One way that pet owners tried to solve the problem was to place money in trust for the care of the pet, with the family member or friend acting as the trustee. While this technique looked official, there was a real problem with it - pets are not people, and the law only recognized trusts when people were the beneficiaries. The legal effect of these so-called honorary trusts was not very satisfactory. Since no one was able to enforce these trusts (i.e., the pets couldn’t defend themselves), the trustees were free to do as they pleased. If a trustee was also named as the beneficiary of any money left over after the pets died, guess what happened. The Trustee took the money - and put the pets in the shelter. In 1991, the Uniform Probate Code was adopted by the National Conference of Commissioners on Uniform State Laws (ULC). Section 2-907 of that Uniform Probate Code provided that a pet trust could be enforced if an individual was designated for that purpose in the trust instrument or if an individual was so appointed for that purpose by the court. In 2000, the National Conference of Commissioners on Uniform State Laws adopted the Uniform Trust Code, Section 408 of which authorizes pet trusts under a provision very similar to the Uniform Probate Code. The breakthrough with these two pieces of model legislation was that, for the first time, there was legal authority for the existence of a pet trust and there was a mechanism to enforce the provisions of the trust if the trustee did not carry them out as instructed. In other words, the trustee could now be forced to actually use the money for the care and protection of the pets! While this was great news for pet owners, these two pieces of model legislation are not governing law. Instead, they are simply models that may be considered for legislative enactment, in one form or another, by each of the 50 states. The intent, of course, is that all 50 states will adopt the model legislation so that all states will have identical laws. As of this date, close to half of the states and the District of Columbia have enacted legislation authorizing pet trusts, based in whole or in part on the Uniform Probate Code and the Uniform Trust Code, and at least 6 states have similar legislation pending. If you happen to live in any of the states that have authorized pet trusts, you may want to expand your estate planning horizons to include a provision for your pets. But the time you spend together on your honeymoon is the first time you will spend together as husband and wife, and deserves a little more thought. Today, most divorces are filed after family vacations after a couple spends time alone together (or together with their children). As an engaged couple, you probably cant imagine disliking your spouse, but statistics show that many people wind up feeling that way. I hadnt realized that when my fiance said we were going to the middle of nowhere, he meant it. I would have preferred to eat dinner out each night and save my experiments in cooking for our first few days at home. But cooking may be a dream for you. If so, make sure that you can get the supplies you need within a reasonable location. And, as mentioned before, if you want to spend most of your time in the hotel room, choose a place with an attached dining room and/or room service. You may have a limited budget to work with, or someone may have already selected the destination for your honeymoon. The important thing is that you sit down with your spouse-to-be and communicate what expectations you each have. The last thing you want is to fight over what to do on your honeymoon. This combination and not just the food alone, is what really shapes your health and well-being. In Ayurveda, each body is unique with unique dietary needs. Your Ayurvedic practitioner will check your body constitution, age, the environment you live in, what is currently causing you to have an imbalance between mind and body. However, there are key Ayurvedic diet principles that are universal and the following are simple ways to integrate the Ayurvedic way of eating into your usual eating habits. First, it is suggested that you add the freshly squeezed juice of half a lemon to a hot cup of water or add lemon zest to your herbal tea. This should be drunk first thing in the morning before breakfast. This warm lemon juice is good for all body types because it aids intestinal cleansing by slowing the growth of disease-causing bacteria in the digestive system. Nothing else but food should be on the table during mealtimes. Try to eat in a peaceful and happy atmosphere as much as you can. Fourth, eat lunch properly. Most of us skip lunch or just grab a bite because we’re too busy. In Ayurveda, lunch is THE most important meal of the day. Mid-day is the time when digestion is at its natural peak for your body to complete the digestion process fully. A heavy meal at night is discouraged because eating a heavy dinner results in a lot of undigested food that gets clogged in your system. It’s harder to fall asleep after a heavy dinner. Weight gain can also be inevitable. After eating a full lunch, it is suggested that you take time to relax and sit quietly. This gives your body a chance to digest well before you resume your daily activities. Fifth, drink lots of water. The Ayurvedic beverage of choice is pure, lukewarm water. Water is important for digestion and absorption of nutrients. It helps flush out toxins and prevents bloating and constipation. There are, however, several reasons why getting a dog may be the best thing you ever do, in terms of weight loss. Having a dog can lead to several small but significant lifestyle changes that all add up, over time! For one thing, a dog requires a minimum of one hour a day of walking and thats every day, not just sunny days, and not just when you feel like it. Of course, you can just take the dog into the yard and throw the ball for it, but why not take advantage of your canine companion and go for real walks every day? Its better for you, and better for the dog. Over time, it gets to be very enjoyable. Some people feel that just the act of getting a new puppy is weight loss measure in and of itself. Until its trained, its more than likely to keep you on your toes youll be lucky to get a chance to sit down and eat, let alone cook! That initial crazy period usually ends pretty quickly, though. Besides walking, here are some other tips for easy weight loss with dogs. Heres a great trick feed any bits of food you dont want or think you shouldnt eat to the dog. For example, I havent eaten a toast crust in over two years. I used to eat them just to be rid of them. It just seems wrong to throw them in the garbage, somehow. But feeding them to the dog is nothing more or less than symbiotic. You may not think this is a great weight loss measure, by the way, but Im sure that all those crusts add up! I must admit (and veterinary dog food purists, close your ears!) that it goes a bit further than that. What if you have made a yummy pasta dish, and theres just a little left, not really enough to be worth putting in a plastic container and saving? If its not so good, Id throw it out, but if it is good, that puts me in a spot. Ill probably either eat it outright despite being full, or pick away at it over the course of a few hours until its gone. This can be avoided if you just simply and automatically give it to the dog. After all, dogs evolved alongside humans for millennia in exactly this way. They ate the leftovers of whatever their human companions were eating. Nowadays, the pet food industry cautions us against doing so, but if the food youre eating is reasonably healthy, whos to say that feeding small bits of it to the dog will do the dog any harm at all? Personally, I have, on occasion, sunk even lower than that in canine gastrointestinal abuse. There is a brand of white cheddar popcorn, marketed as Smartfood and sold in huge bags, with about a day and a half worth of calories in each. I love it. I love it so much I have been known to eat a whole bag over the course of a few hours. Its delicious. Its the kind of thing I should never buy a bag of. But if I do, and Ive ripped into it, and its disappearing, I can do damage control by periodically pausing in my binging to tip large amounts of the popcorn into a bowl on the floor, where it is just as quickly eaten up by the dog. It helps to have a big dog. I dont know that any of these measures would work so well with a little one that cant eat quickly. It helps, also, if the dog is at least half black lab. They are purported to have iron cast stomachs, rather like goats, and this has proven to be true in the case of my dog as proven when, at the age of eleven months, she ate four tubes of oil paint, metal and all. She ate all the reds, yellows and oranges, strangely enough ignoring the cool side of the color wheel completely and, amazingly, suffered no ill consequences at all!
